Innocent Spouse / Separation of Liability Relief

When a married couple files a return jointly, both parties are legally responsible for the entire tax liability, even additional tax, interest and penalties that arise after they divorce. Even if your divorce decree states that your former spouse will be responsible for any amounts due on previously filed returns, the IRS will still look to you to satisfy the debt. In some cases, however, a spouse may qualify for relief as an Innocent Spouse, or for Equitable Relief or Separation of Liability Relief.
